Transgender Rights vs Women's Rights by Robert Wintemute explores the conflicts between transgender rights and women’s rights, emphasising the necessity of calm, rational, public debate to resolve these issues. Freedom of expression is highlighted as a critical right that allows women to question certain demands of trans rights activists, even if it may cause offence. Disagreement is not akin to hatred, and the term “transphobia” should be narrowly defined as acts or statements indicating hostility or prejudice towards transgender persons.

If the right to speak about these conflicts is protected, and we acknowledge the broad areas of agreement regarding transgender people’s human rights, we can then address the substance of these conflicts.

Should an individual be able to change their legal sex? If so, how easily? Should it require a diagnosis of gender dysphoria and a waiting period, or should self-identification suffice? Alternatively, should sex be removed from birth certificates, eliminating the need for change?

Wintemute examines these conflicts in detail, contrasts transgender rights with lesbian, gay, and bisexual (LGB) rights, and proposes ways to achieve co-existence among transgender rights, and women’s and children’s rights.
